The inspector checks each obligation in four ways: documents, records, a walk-through and interviews with workers chosen by sampling. Almost all recent NOMs include their own assessment procedure. The documents requested most often are the safety assessment and program (NOM-030), the safety and hygiene commission (NOM-019), fire prevention (NOM-002), the PPE analysis (NOM-017) and the psychosocial risk policy (NOM-035).
1How each obligation is checked
Under most standards, evidence can be presented on paper or electronically.
2How many workers are interviewed
Recent standards use the same sampling table (for example, NOM-009, NOM-017, NOM-033, NOM-035 and NOM-036-1):
| Workers at the site | Workers interviewed |
|---|---|
| 1 to 15 | 1 |
| 16 to 50 | 2 |
| 51 to 105 | 3 |
| More than 105 | 1 for every 35, up to 15 |
3The documents requested most often
| Standard | What to have ready |
|---|---|
| NOM-030-STPS-2009 | Designated safety and health officer, assessment and annual program (with fewer than 100 workers, a list of actions), and follow-up reports. |
| NOM-019-STPS-2011 | Minutes forming the safety and hygiene commission, annual walk-through program, walk-through minutes at least quarterly and annual training for its members. |
| NOM-002-STPS-2010 | Fire risk classification, monthly extinguisher checks, emergency plan, drills (1 or 2 a year) and annual training program. |
| NOM-017-STPS-2024 | Risk analysis by job for PPE, delivery and replacement records, and training. |
| NOM-026-STPS-2008 | Visible signage in good condition, and training to interpret it. |
| NOM-001-STPS-2008 | Record of the visual inspection of the facilities, at least every 12 months. |
| NOM-035-STPS-2018 | Prevention policy communicated to staff; in workplaces with more than 15 workers, a risk factor assessment at least every two years. |
On top of these come the standards for your activity: work at height (NOM-009), confined spaces (NOM-033), welding (NOM-027), electrical maintenance (NOM-029), forklifts and cranes (NOM-006), construction (NOM-031), among others.
4Training is proven with certificates
Under several standards, training is proven with certificates of job skills (DC-3 format) issued by the company or by a training agent registered with the STPS. Companies must keep copies of the certificates from the last year.
More detail in the guide DC-3 certificate.
5If the inspector finds non-compliance
The Federal Labor Law (art. 994, sec. V) sets fines of 250 to 5,000 UMA for employers who do not comply with safety and hygiene standards: MXN $29,327.50 to $586,550 with the 2026 UMA of $117.31.
Verification unit. Under almost all NOMs, hiring one is optional. A favorable, current ruling serves as evidence of compliance before the authorities.
- Conformity assessment procedures of NOM-001, 002, 009, 017, 019, 026, 030, 033, 035 and 036-1-STPS.
- Federal Labor Law (Ley Federal del Trabajo), art. 994, sec. V.
